What is a HELOC?

A home equity line of credit is a revolving loan against your home, like a credit card with a much lower rate and your house as collateral. You draw what you need during the draw period, then repay. In Texas, a HELOC on your homestead follows special constitutional rules.

What is the difference between a HELOC, a home equity loan, and a cash-out refinance?

A HELOC is a revolving line. A home equity loan is a lump sum with a fixed payment, usually in second position. A cash-out refinance replaces your first mortgage with a larger one and you take the difference in cash. If your first-mortgage rate is low, a second-lien HELOC or equity loan often beats blowing up that first rate.

How much can I borrow with a Texas HELOC?

Texas caps combined loans on a homestead at 80% of fair market value. Example: $500,000 value and a $300,000 first mortgage leaves up to $100,000 of room, not $200,000. The last 20% of equity stays in the house. That 80% cap is in the Texas Constitution.

Why is Texas only 80% when other states go higher?

Texas writes home-equity rules into the constitution to protect homesteads. Other states may allow 85% or 90% HELOCs. Here, 80% combined is the ceiling on a homestead, period. Investment properties that are not your homestead follow different rules.

What is the 12-day waiting period?

You cannot close a Texas homestead equity loan or HELOC until 12 days after you apply or receive the required notice, whichever is later. It is a cooling-off period, not a stall tactic. Build it into your timeline if you need funds by a certain date.

Why is there a $4,000 minimum draw on a Texas HELOC?

The Texas Constitution requires each advance on a homestead HELOC to be at least $4,000. It is not meant for coffee-shop swipes. Plan draws in chunks. That rule is easy to miss if you used a HELOC in another state.

Can I have more than one home equity loan on my Texas homestead?

Generally no. Texas allows one 50(a)(6) home-equity loan or HELOC on a homestead at a time. An open HELOC, even with a zero balance, can block a new equity loan until it is closed and released. Tell us about every line that is still open.

Is a HELOC a variable rate?

Most HELOCs use a variable rate tied to an index, so the payment can move. Some lenders offer a fixed-rate conversion on draws. If you need a payment that never changes, a closed-end home equity loan or a cash-out refinance may fit better.

What is the draw period versus the repayment period?

The draw period is when you can take money (often 5 to 10 years). After that, many HELOCs switch to repayment only, and the payment can jump because you are paying principal too. Ask us to show the worst-case payment before you sign.

Are HELOC closing costs capped in Texas?

Texas limits certain lender fees on homestead equity loans. Third-party costs like appraisal and title still apply. Compared with a full refinance, a second-lien HELOC can still be cheaper to open. Your Loan Estimate or Texas equity disclosures show the real number.

What credit score do I need for a HELOC?

There is no single constitutional score. Most lenders want solid credit, often around 680+ for the best HELOC pricing, and they still underwrite income and combined LTV. A recent mortgage late is a bigger problem than a small card balance.

Do I need to document income for a HELOC?

Yes on most files. Paystubs and W-2s for employees, tax returns if you are self-employed. A HELOC is still a loan. “No income check” ads are not how Texas homestead equity lending actually works for most people.

What can I use a HELOC for?

Common uses are home improvements, debt consolidation, education, or a down payment on another property. The lender may ask the purpose. Using homestead equity to buy more real estate is allowed in many cases, but the 80% cap and one-loan rule still apply.

Should I keep my low first-mortgage rate and add a HELOC?

Often yes. If you closed a 3% first mortgage in 2020–2021, replacing it with a 6% cash-out refinance to pull $40,000 is usually expensive. A second-lien HELOC leaves the cheap first mortgage alone. We will run that comparison with your actual rates.

Does a HELOC only work on my homestead?

The strict Texas 50(a)(6) and 50(t) rules apply to homestead property. A non-homestead rental can use different investor or second-lien products, without that 80% constitutional cap. Occupancy is the fork in the road. Tell us which house you live in.

Can I get a HELOC on a rental property?

Often as a non-homestead second lien or cash-out on the rental, using investor guidelines, not the homestead HELOC statute. Down payment leftover, LTV, and DSCR or personal income still matter. Do not assume your primary-home HELOC can sit on a rental.

How long does a Texas HELOC take to close?

Plan around the 12-day wait, plus appraisal and title. Many files land in the two-to-four-week range if documents are in. You also have a three-day right to cancel after closing on many equity loans. Rush jobs still have to honor the clock.

Where do I have to close a Texas HELOC?

Texas requires homestead equity closings at a lender’s office, a title company, or an attorney’s office. You cannot close this one at the kitchen table. That is another constitutional consumer protection.

Is HELOC interest tax-deductible?

Sometimes, if the funds are used to buy, build, or substantially improve the home that secures the loan, under current IRS rules. That is not tax advice. Ask your CPA before you count on a deduction.

Can I pay off a HELOC early?

Texas homestead equity loans cannot have a prepayment penalty. You can pay it down or close it. If you plan to take a new equity loan later, remember the one-at-a-time rule: the old HELOC has to be released.

What happens to the HELOC if I sell the house?

It gets paid off at closing, like your first mortgage. The title company requests a payoff. Keep a little extra room. HELOC payoffs can change if you drew more after the first quote.

I heard I cannot draw if I am above 50% LTV. Is that still true?

That old 50% advance limit was largely repealed for Texas HELOCs established on or after January 1, 2018. Newer lines generally follow the 80% combined cap instead. If your line is older, the old rule may still apply. We will read your note, not a blog.

Will opening a HELOC hurt my credit?

The application is a hard inquiry, and a new account can move the score a little. Using a large share of the line can also look like high utilization. Used gently, the effect is usually modest. Used like a maxed-out card, it can sting.

Who should not get a HELOC?

Anyone who needs the payment to stay fixed, anyone who would treat it like extra income, or anyone who cannot keep taxes and insurance current. A HELOC is cheap flexibility, not free money. If the first mortgage is already high, the 80% cap may leave you little room anyway.

Why use a broker for a Texas HELOC?
